According to the help file - and Hoyle, and Pretty Good Solitaire, for that matter - the initial Scorpion layout should have twelve face-down cards, three in each of the four leftmost columns. Action Solitaire deals sixteen face-down cards, four in each of those columns. - ZM, who just upgraded to version 1.1

Yes, we are aware of the discrepency between the implementation of Scorpion in Action Solitaire versus other games (and even Action Solitaire's own help file :-)). It was only discovered after release, but a change is scheduled for the next update.
